End User Licence Agreement (EULA)

1Acceptance of Agreement

This End User Licence Agreement ("EULA") is a legal agreement between you ("User") and Roomer S.r.l. ("Roomer", "we", "us") governing your use of the Roomer mobile application (the "App").

By downloading, installing or using the App, you confirm that you have read, understood and fully accepted this EULA. If you do not accept these terms, do not install or use the App.

Before completing registration or logging in you will be required to explicitly accept this EULA. Acceptance is mandatory to access the Service.

2Licence Grant

Roomer grants you a limited, non-exclusive, non-transferable and revocable licence to install and use the App on devices you own or control, solely for your personal, non-commercial use and in accordance with this EULA.

You may not:

  • Sublicence, sell, resell, transfer, assign or distribute the App.
  • Modify, translate, adapt or create derivative works of the App.
  • Reverse engineer, decompile or disassemble the App.
  • Remove any copyright or proprietary notices from the App.
  • Use the App for commercial purposes or on behalf of third parties.

3Prohibited Content and Zero Tolerance

Roomer operates a zero-tolerance policy towards objectionable content and abusive behaviour. By using the App, you explicitly agree not to post, send or share content that:

  • Is sexually explicit, obscene or pornographic.
  • Promotes violence, self-harm or illegal activities.
  • Contains hate speech, discrimination or harassment based on race, ethnicity, religion, gender, sexual orientation, disability or any other protected characteristic.
  • Depicts minors in an inappropriate or sexualised manner.
  • Is defamatory, false or misleading about other users or third parties.
  • Violates others' privacy (e.g., sharing images or data without consent).
  • Constitutes spam, phishing or unsolicited commercial communications.
  • Contains malware, viruses or other harmful code.

Breach of this policy will result in the immediate removal of the content and may lead to temporary or permanent account suspension, and in serious cases, referral to the relevant authorities.

4Reporting Content and Blocking Users

Roomer provides users with tools to keep the community safe and respectful:

  • Report content: You can report any profile, image or message you consider objectionable using the dedicated report button ("Report") available on every user profile and in the chat. Every report is reviewed by the Roomer moderation team.
  • Block users: You can block any user at any time from their profile or the chat. A blocked user will not be able to view your profile or contact you.

We are committed to reviewing reports received within 48 hours and taking appropriate action. For urgent reports or safety concerns you can contact us directly at support@roomerapp.it.

5Content Moderation and Removal

Roomer reserves the right, but not the obligation, to monitor content on the App. We employ the following moderation measures:

  • Manual review of user-reported content.
  • Removal of content that violates this EULA or the Terms & Conditions.
  • Temporary or permanent suspension of accounts that breach community rules.
  • Blocking of users who engage in abusive or harassing behaviour.
  • Cooperation with relevant authorities in the event of unlawful content.

Content removal or account suspension does not entitle users to refunds or compensation of any kind, unless otherwise required by law.

6Intellectual Property

The App, including logo, design, source code, algorithms, graphics, text and all other elements, is the exclusive property of Roomer S.r.l. and is protected by Italian and international copyright and intellectual property laws.

Content you upload to the App remains your property. However, you grant Roomer a limited licence to use it solely for the purpose of providing the Service, as described in the Terms & Conditions.

7Privacy and Personal Data

The processing of your personal data is governed by our Privacy Policy, which forms an integral part of this EULA. We encourage you to read it carefully before using the App.

Using the App involves the collection and processing of personal data as described in the Privacy Policy, in compliance with the GDPR and applicable Italian law.

8Disclaimer of Warranties

The App is provided "as is" and "as available", without warranties of any kind, express or implied. To the maximum extent permitted by law, Roomer disclaims all warranties including as to:

  • The App's fitness for a particular purpose.
  • The App being free of errors, interruptions or viruses.
  • The accuracy or completeness of information provided through the App.
  • Matching results or compatibility between users.

9Limitation of Liability

To the maximum extent permitted by applicable law, Roomer is not liable for any direct, indirect, incidental, special, consequential or punitive damages arising from your use of or inability to use the App, including:

  • Conduct or actions of other users encountered through the App.
  • Objectionable content posted by third parties prior to its removal.
  • Data loss or service interruptions.
  • Damages resulting from unauthorised access to your account.

Nothing in this EULA excludes or limits Roomer's liability for death, personal injury caused by wilful misconduct or gross negligence, or any other liability that cannot be excluded by law.

10Term and Termination

This EULA is effective from the moment you install the App and remains in force until terminated.

This EULA terminates automatically upon uninstalling the App or deleting your account. Roomer may terminate this EULA and revoke the licence at any time if you breach its terms.

Upon termination you must cease all use of the App and uninstall it from all your devices. Provisions that by their nature survive termination (including those relating to intellectual property, limitation of liability and governing law) shall remain in force.

11Apple App Store Provisions

If you downloaded the App from the Apple App Store, the following provisions apply in addition to the rest of this EULA:

  • This EULA is between you and Roomer, not between you and Apple Inc. Apple is not responsible for the App or its content.
  • The licence granted is limited to use of the App on Apple-branded devices you own or control, as permitted by the App Store Usage Rules.
  • Apple has no obligation to provide maintenance or support for the App. If the App fails to conform to any applicable warranty, you may notify Apple, which will refund the purchase price; Apple has no other warranty obligation.
  • In the event of third-party claims relating to the App (including intellectual property infringement claims), Roomer — not Apple — is responsible for addressing such claims.
  • Apple and its subsidiaries are third-party beneficiaries of this EULA and, upon your acceptance, will have the right to enforce this EULA against you as a third-party beneficiary.

12Governing Law

This EULA is governed by Italian law. For any dispute relating to this EULA, the parties agree to attempt an amicable resolution. Failing that, the courts of Milan shall have jurisdiction, without prejudice to consumer rights under applicable law.
